Hospital Employed Doctors

Working within the public health system means that you will generally be indemnified by your employer for negligence claims that result from your provision of patient care.

We are often asked why it's necessary for hospital-employed doctors (HEDs) to hold their own cover above and beyond what is provided as part of their employment. Put simply, the cover provided by the employer does not always extend to cover all the areas of potential exposure.

For example:

  • Many doctors working in the public health system undertake some private practice or locums on the side. Any private practice outside hospital employment requires individual indemnity cover.
  • While HEDs are generally covered for civil (ie negligence) claims by their employer, other inquiries, complaints and proceedings may not always be covered. For instance, if there is a coronial inquest and two or more practitioners from the same hospital are involved, this may present the hospital with a conflict of interest.
  • Medical Board matters, employment disputes and investigations may not always be covered.
